Diggt Habit - Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Diggt Habit mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Diggt Habit is a habit tracking application that helps users monitor and improve their daily habits. The App offers both free and premium subscription features.

3. Subscription Terms

The App offers auto-renewable subscriptions:

  • Monthly Subscription: $2.99/month
  • Annual Subscription: $19.99/year

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.

4. Free Trial

New subscribers may be eligible for a 7-day free trial. The trial will automatically convert to a paid subscription unless cancelled before the trial period ends.

5. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account
  • All activities that occur under your account
  • Ensuring your device meets the minimum system requirements
  • Using the App in compliance with applicable laws

6. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices.

7. Intellectual Property

The App and its original content, features, and functionality are owned by Diggt Habit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Prohibited Uses

You may not use the App:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information

9. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Disclaimer

The information on this App is provided on an "as is" basis. To the fullest extent permitted by law, this Company:

  • Excludes all representations and warranties relating to this App and its contents
  • Excludes all liability for damages arising out of or in connection with your use of this App

11. Pedometer and Step Counting Disclaimer

The step counting feature in this App uses device sensors and may not be accurate. Step counts are estimates only and may vary based on:

  • Device placement and movement patterns
  • Sensor calibration and device model
  • Environmental factors
  • User activity type

Step counts are provided for informational purposes only and are NOT intended for:

  • Medical diagnosis or treatment
  • Health monitoring or medical decision-making
  • Fitness or exercise prescription
  • Any legal or official purposes

For accurate step counting, we recommend using integrated health data services (Apple HealthKit or Google Fit) when available, which may provide more accurate measurements from wearable devices.

12. Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
